H&S Legislation & Regulation Update
During this two-hour update session, we will discuss recent Health and Safety at Work Act cases which have made their way through the WorkSafe New Zealand and our Courts.
What are Enforceable Undertakings?
- WorkSafe will consider entering into an agreement with a duty holder following a breach (including an alleged breach) of the Health and Safety at Work Act. The enforceable undertaking agreement specifies the actions the duty holder will undertake to respond to the contravention and is generally used as an alternative to prosecution.
What is a Prosecution?
- WorkSafe actively enforces the law by a number of means, including the prosecution of alleged offenders. Prosecution action, through our Courts, ensures that those who breach the law are held to account, and assists in promoting good health and safety values and practices.
During the update session we’ll highlight key learnings, observations and trends from the cases we’ll discuss. We’ll also examine the actions you can take to prevent similar events from occurring in your workplaces.
