SEPTEMBER 2024 Case Law Updates: A Summary

September 2024 Update: Case Law summary for the month from across New Zealand.

This month has seen a range of employment disputes and legal developments, highlighting the importance of procedural fairness and statutory compliance. Notable cases include employers being penalized for breaches of employment agreements, including migrant exploitation and collective agreement violations. Some employers faced costly outcomes for failing to provide statutory rights, while others were found to have followed correct procedures, such as in dismissals for failure to follow training or for absenteeism management. Casual employees were a focus, with dismissals via text message and claims of constructive dismissal, often tied to a lack of proper process.

Additionally, several legislative bills remain open for submission, signaling ongoing efforts to address employment law challenges. Missteps in handling issues like sexual harassment, unjustified dismissals, and flawed processes continue to impact employers, emphasizing the need for adherence to legal standards.
